Hello fellow members,
Has anyone won an appeal from an ERICA Disability Insurance company such as UNUM that classified fibromyalgia as a "self reporting condition"?

Hi, mashby.
I don't know if this information will be of further help to you, but I thought to share a link to the Department of Labor's website which provides information on ERISA disability claims and appeals.

It is very difficult to work with ERISA laws; With SSD, attorneys are motivated to take your case, because they generally garnish 25 % of retroactive SSD benefits. With ERISA, they get nothing and often the insurance company will hire their own attorneys to file for SSD and then they garnish the wages
I don't think that most people understand this. And honestly with FM appearing to be so "vague" your insurance company may fight you tooth and nail.
You may want to consult an attorney to see if it is even worth the hassle vs. filing for SSD.
Good Luck
