Duty to Accommodate (Canada) Reasonable Accommodation (US)

When browsing through various posts it appears that some of the members have lost jobs due to their disability. I was wondering if members were aware of the Employers Duty to accommodate in Canada and Reasonable Accommodation in the US (not sure about the other countries) There are lots of ifs, ands and buts in this legislation and the employer is not obligated to accommodate to the point of undue hardship to the employer. The employee also has to play an active part in this process by identifying limitations up front.

Although employers often feel that accommodation is costly, they need to consider the cost of hiring and training a new employee. I’d suggest that if you find yourself in the position where you know your work is deteriorating as a result of your disability, you look to see if in fact your employer falls under this legislation. You then need to look at what the implications/ramifications in proceeding with a request for Accommodation. It is easier to proceed if you have union representation or a supportive HR Department

Hi B2, and thank you for your post, I wanted to bring this up to page one… Bec it seems there are many struggling with their employers, Iv been there, and sometimes wish I had fought more for my job than I did.
I know many in the past have posted discussions about if they should share their dx of fibro with their employer. This continues to be a huge issue, sadly we are often to tired to fight for our rights.
I hope some see this and become encouraged by it !
